A former Carroll County Intermediate School custodian will serve no prison time as part of a plea agreement Monday in Carroll County Circuit Court relating to the grand larceny of more than $25,000 from school vending machines.

James T. Spicer, 55, was originally charged with eight counts of grand larceny after he allegedly took more than $25,000 from vending machines at CCIS from July 1, 2007 to June 11, 2008. As part of the plea agreement with the Commonwealth, seven of the eight charges against Spicer were dropped Monday.

Represented by attorney Nathan Lyons, Spicer then pled no contest to the one remaining charge of grand larceny Monday, even though the charge carried a maximum sentence of 20 years in the Department of Corrections. As part of the plea agreement, Carroll County Circuit Court Judge Brett Geisler upheld the Commonwealth’s recommendation of a 5-year suspended sentence in the DOC. Geisler then ordered Spicer to serve those five years on active supervised probation. He also ordered Spicer to pay restitution to the Carroll County School System in the amount of $25,234.70. Spicer paid that amount in full before Monday’s court proceedings. Carroll County Superintendent of Schools Dr. Greg Smith picked up the check from the court shortly after Spicer’s hearing Monday.
