The 31-year-old Cana man recently sentenced to serve five years in prison after being found guilty of possession of a firearm by a violent convicted felon will now have to serve an additional 10 years.
According to Carroll County Commonwealth’s Attorney Nathan H. Lyons, Glen Donald McMillian of Cana plead guilty to one count of Possessing a Firearm by a Violent Convicted Felon, one count of Possessing Ammunition by a Convicted Felon, one count of Threatening to Burn a Dwelling (House) and one count of Perjury on Thursday, March 21.
McMillian was sentenced to 30 years in the Virginia Department of Corrections. After he serves five years, he will have the remaining 25 years suspended, Lyons said. McMillian was also found guilty of violating the terms of his probation from a 2009 conviction. McMillian was sentenced to serve five additional years on that charge. These sentences shall run consecutively with a 5-year sentence that McMillian received from a jury on February 21.
All together, McMillian will serve an active sentence of 15 years in the Virginia Department of Corrections. Once he is released, McMillian will be placed on probation for a period of five years. He will have a total of 32 years and 8 months of suspended time remaining upon release, meaning if he violates his probation, a judge could send him back to prison for that amount of time.
The Commonwealth’s Attorney’s Office has worked diligently with the Carroll County Sheriff’s Office on these cases in order to obtain these convictions and prison sentence.
“We just hope the citizens of the county and the community of Cana will feel a little bit safer now that Mr. McMillian is behind bars for a substantial period of time,” said Michael Jones, Chief Deputy Commonwealth’s Attorney for Carroll County.
Jones said the charges stem from three separate incidents, a threaten to burn charge in which McMillian was found guilty during a bench trial, the possession of a firearm by a violent convicted felony that McMillian was found guilty of during a Feb. 21 trial, and a separate incident for Possession of a firearm by a Violent Convicted Felon, Possession of Ammunition by a Convicted Felon and perjury related to a July 2, 2012 incident.
On that date, Deputy Joe Holderfield of the Carroll County Sheriff’s Office served McMillian a warrant for his arrest when he noticed a firearm in McMillian’s residence, Jones said. After McMillian was arrested, the Carroll County Sheriff’s Office obtained a search warrant for the McMillian residence, where deputies found multiple firearms and thousands of rounds of ammunition, Jones said. Later that day when Deputy Holderfield brought McMillian to the Carroll County Magistrate’s Office to be arraigned, McMillian made a false statement to the Magistrate, leading to the perjury charge, Jones said.
